Not So Fast, Mayor Bloomberg! New York City’s Ban on Supersized Soda is Reversed!

Sugary DrinksMarch 11, 2013 – In an effort to help curb the obesity epidemic, Mayor Bloomberg proposed a ban on selling sugary drinks larger than 16 ounces in York City restaurants and the proposal  was approved by the New York Board of Health.   But today, NBC Nightly News with Brian Williams reported that the ban was reversed by the New York State Supreme Court. 

NBC’s News Correspondent Rehema Ellis reported that the Supreme Court  judge ruled the ban was “arbitrary and capricious. ”  Arbitrary because a drink that you cannot buy in a restaurant can be bought in a store right next door to the restaurant.  Also the ban does not cover “all high calorie sugary drinks”

The American Beverage Association, in a written statement says, “The court ruling provides a sigh of relief to New Yorkers and thousands of small businesses in New York City that would have been harmed by this arbitrary and unpopular ban…”

Rehema Ellis reminded us that this is not the first time Mayor Bloomberg has tried to enact laws that would effect public health.  Bloomberg won court approval to force restaurants to post calorie information and to ban artificial trans fat in restaurant food.

The Mayor plans to appeal this new ruling.

In a conference the Mayor states, “We believe that the judge’s decision was clearly in error and that we will prevail on appeal. If we are serious about fighting obesity, we have to be honest about what causes it and we have to have the courage to tackle it head on.”

Ellis states “In a city of more than 8 million, where health officials say the obesity epidemic is responsible for more than 5000 deaths a year, the Mayor says his fight to make New Yorkers healthier will continue.”
